Wholly owned municipal firms are protected against competitive tenders. Can they hold out against consolidation?
The European Court of Justice has ruled that only services which are undertaken by entities which are 100% owned by municipalities can legally avoid open tenders. If an entity carrying out a service has any degree of private sector involvement, there must be competitive bidding for the contract.
